These Terms & Conditions (“Terms”) govern all purchases made through https://vicaragespirit.com (“the website”). By placing an order you agree to these Terms. Please read them carefully before ordering.

2. Age Restriction
You must be 18 years of age or older to purchase alcohol from this website. It is an offence under the Licensing Act 2003 to sell alcohol to anyone under 18, and an offence for anyone under 18 to attempt to purchase alcohol.
By placing an order you confirm that you are at least 18 years old and that the person who will receive the delivery is at least 18 years old. We operate an age verification policy (Challenge 25): our delivery partners may require photographic proof of age on delivery and will refuse to hand over goods if proof cannot be provided. If delivery is refused for this reason, we may deduct reasonable redelivery or processing costs from any refund.
3. Products
All products are sold subject to availability. Product images are for illustration; bottle presentation, labelling and vintage may vary slightly. Alcohol by volume (ABV) and bottle size are stated on each product page.
4. Orders & Contract Formation
When you place an order you will receive an order confirmation email. This is an acknowledgement, not acceptance. A contract is formed only when we dispatch your order. We may refuse or cancel any order before dispatch — for example where age verification fails, payment is declined, stock is unavailable, there is a pricing error, or fraud is suspected — in which case any amount paid will be refunded in full.
5. Prices & Payment
Prices are shown in pounds sterling (GBP) and include UK VAT and excise duty. Delivery charges, where applicable, are shown at checkout before you confirm your order.
Payment is taken at the time of ordering via the payment methods displayed at checkout (card payments are processed by Stripe). We do not store your full card details. In the event of an obvious pricing error we will contact you before dispatch to confirm or cancel the order.
6. Delivery
We deliver to United Kingdom addresses only. We do not currently ship internationally.
Estimated delivery times are shown at checkout; they are estimates and not guaranteed. Deliveries require a signature from a person aged 18 or over at the delivery address. If no eligible adult is available, the courier will leave instructions for redelivery or collection.
Risk in the goods passes to you on delivery. Ownership passes when we receive payment in full.
7. Cancellation & Returns
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel your order within 14 days of the day after delivery, without giving a reason.
To be eligible for a refund under this right:
- Bottles must be unopened, with seals intact, and in their original packaging;
- You must notify us within the 14-day period at admin@vicaragespirit.com (you may use the model cancellation form below, but it is not obligatory);
- You must return the goods to us within 14 days of notifying us. Return postage is at your cost unless the goods are faulty. We recommend a tracked and insured service, as the goods remain your responsibility until they reach us.
We will refund the price paid plus standard outbound delivery costs within 14 days of receiving the goods back (or of you providing proof of return). We may reduce the refund to reflect any diminished value caused by handling beyond what is necessary to establish the nature of the goods.
This cancellation right does not apply to goods that are sealed for health protection or hygiene purposes once unsealed, or to goods personalised at your request.
8. Damaged or Faulty Goods
If your order arrives damaged, leaking, broken or otherwise faulty, you must notify us at admin@vicaragespirit.com within 48 hours of delivery, providing your order number together with clear photographs of the affected bottle(s) and of the packaging in which they arrived. Please retain the goods and all original packaging until the claim is resolved, as our delivery partner may require them for inspection. Failure to report within this period, or disposal of the packaging, may affect our ability to process the claim.
Once verified, we will offer a replacement or a full refund, including delivery costs, in accordance with the Consumer Rights Act 2015. Where damage occurs in transit we will pursue the matter directly with our delivery partner — you do not need to deal with the courier yourself. Nothing in these Terms affects your statutory rights.
9. Trade Customers
Sales to trade customers (retailers, wholesalers, on-trade) are subject to account opening and due diligence checks as described in our Legal Policy, and to any separately agreed trade terms. In business-to-business sales, unless otherwise agreed in writing: (a) risk in the goods passes to the buyer when the goods are handed to the carrier; (b) the consumer cancellation rights in section 7 do not apply; and (c) claims for transit damage must be made by the buyer against the carrier, with any shortage or damage noted on the delivery documentation at the time of receipt.
10. Responsible Drinking

11. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Subject to that, our total liability arising from any order is limited to the price paid for that order, and we are not liable for indirect or consequential losses. We are not liable for delays or failures caused by events outside our reasonable control.
12. General
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction (consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts). If any provision is found invalid, the remainder continues in force. We may update these Terms from time to time; the version in force at the time of your order applies. These Terms do not affect your statutory rights.
